Your NFT your IP rights!

IP Transfer on Purchase: After purchasing our NFT, we grant you full IP rights in accordance with the following conditions

Prohibited Uses

  • Illegal and Harmful Use: The NFT and any associated assets cannot be used in connection with hate speech, defamation, or activities promoting harm, discrimination, or illegal activities.

  • Association with Competing Brands: NFT holders are prohibited from using the asset to represent or endorse competing brands or projects without permission from the creator.

  • Unauthorized Third-Party Licensing: NFT holders cannot sublicense, lease, or otherwise authorize third parties to use the asset without written consent from the creator. (Open a ticket in discord if you have questions)

  • Unless explicitly permitted, NFT holders cannot modify or create derivative works based on the original asset. Any derivative creations without permission violate the IP rights retained by the creator.

Ownership Transfer and IP Licensing

  • IP Rights Transfer with NFT Resale: If an NFT is sold on a secondary market, any granted IP rights automatically transfer to the new owner under the same terms.

  • Creator Royalties on Resale: All secondary sales are subject to creator royalties as defined in the smart contract (6.6%). These royalties support the creator and ongoing project maintenance.

  • Term of License: The license granted to the NFT holder remains valid only while they own the NFT. Upon resale, the previous holder’s license and usage rights automatically terminate.

Revocation of IP License

  • Right to Revoke: The creator reserves the right to revoke the IP license granted to any NFT holder if they engage in activities that violate the licensing terms, community guidelines, or any applicable laws.

  • Revocation Procedure: License revocation will be communicated in writing, and the NFT holder will be required to cease all licensed uses. Failure to comply with revocation may result in legal action.

Attribution and Copyright Notice

  • Attribution Requirement: Any permitted public or commercial display of the NFT must include credit to the creator in a form specified in the licensing agreement (e.g., artist name, collection name, or website link).

  • Copyright Notice: Copyright remains with the creator, and any unauthorized use or duplication of the asset is a violation of copyright laws.

This IP rights structure provides clarity and fairness, balancing the creative control of the NFT creator with the enjoyment and usage rights of the collector. Setting out clear IP rules helps create trust in the NFT project, establishing a foundation for long-term success and community engagement.
